Website & Score Keeper Terms of Use

Version: October 18, 2026 · Effective when published on this website.

1. Operator and scope

UpperStatus, Inc., operating HartBeat OS (“HartBeat,” “we,” “us”), provides hartbeatos.com and HartBeat OS Score Keeper. These terms cover website use, inquiries, and authorized use of the Score Keeper social-account integration. They do not establish a paid appliance subscription, employment, an investment, an affiliate relationship, or ownership of contributed work. Separate signed agreements or accepted service orders govern those matters and control their specific subject if inconsistent with these terms.

By using an interactive service after receiving notice of these terms and accepting them where prompted, you agree to these terms. If acting for a business or connecting an account, you must have authority to do so. If you do not agree, do not connect an account or use the interactive service. Merely visiting a public page does not assign your intellectual property to HartBeat.

2. Eligibility and appropriate use

Account-connection functions are for adults aged 18 or older who own or are authorized to manage the account. Provide accurate information, protect your access credentials, and promptly report suspected unauthorized access. Do not impersonate others, upload malicious files, infringe rights, expose confidential information, harvest personal data, evade access controls, overwhelm the service, or conduct security testing without written authorization. Public access does not grant access to private repositories, customer records or administrative systems. Nonwaivable statutory rights remain protected.

3. Score Keeper and connected social accounts

Score Keeper presents dated social-account measurements and growth comparisons. HartBeat OS is its initial business case study. Access to a provider integration depends on that provider’s approval, your authorization, available permissions and a working connection. Describing an integration does not mean it is available or approved. Only an authorized account manager may initiate a connection through the provider’s authorization screen.

For the read-only TikTok integration, the requested access is limited to account identity and profile details, account statistics, and public videos with available engagement counts. The connection does not authorize publishing, deleting or editing videos, reading direct messages, purchasing advertisements, or operating a TikTok Shop. We do not ask for your TikTok password. Provider rules and terms continue to apply, and TikTok does not sponsor, endorse or operate HartBeat OS.

Authorization to retrieve data is not blanket permission to publish another customer’s information. HartBeat’s own approved business measurements are public. Before publishing another connected account’s identifiable profile, videos or measurements on a public scoreboard, we require the account manager’s separate publication choice and authority. Publicly displayed information can be viewed and copied by others.

4. Measurements and limitations

Counts are snapshots of what the provider makes available at the recorded time. API delays, deleted or private content, pagination, permission changes and outages can affect completeness. An unavailable measurement is not zero. A current inventory is not necessarily a lifetime total or the number created during a campaign. Growth requires a comparable baseline; historical values are not invented or backdated. Corrections may change previously shown results. No growth, sales, revenue, investment return or competitive outcome is guaranteed.

AI-assisted material can be inaccurate and requires appropriate human review. Website information is not individualized legal, tax, financial, employment or other professional advice.

5. Your data, content and permissions

You retain your rights in your account and content. You authorize only the access, processing and display needed for the features and publication choices you approve, subject to the Privacy Policy, provider restrictions and applicable law. This is not a transfer of ownership or permission to sell your social data. You must have the necessary rights for content you supply. Third-party and open-source materials remain subject to their respective licenses.

HartBeat and its licensors retain their rights in HartBeat branding, software and website content. Permission to browse does not grant a right to claim endorsement, copy the entire service or misuse trademarks. Lawful reference and other protected uses remain permitted.

6. Disconnecting and deletion

You may revoke authorization through the connected platform’s app-permission settings and request disconnection or deletion using our Data Deletion Instructions. Revocation prevents further authorized access, but does not itself remove records already stored by HartBeat. We process deletion requests under the Privacy Policy, including limited legal and security exceptions. Disconnecting from HartBeat does not delete your TikTok or other social account.

7. Applications and contributions

A résumé, portfolio or application is not automatically company property. The separate Applicant & Submission Terms and any valid, signed contribution agreement govern their subjects. A general website acceptance is not a contribution assignment. A signed agreement must identify the work, rights and consideration before HartBeat relies on ownership or commercial reuse. Prior submissions retain their applicable terms unless a valid later agreement changes them. Public recognition requires separate permission.

8. Offers and communications

Roadmaps, demonstrations, target hardware and indicative prices are not proof of availability or a binding service order. An accepted order must identify actual features, allowances, fees, taxes, support, cancellation and equipment terms. A website visit or information request alone does not authorize a charge. A request authorizes a relevant response, not automatic enrollment in unrelated marketing or automated text campaigns. External portals and services have their own terms.

9. Availability and responsibility

To the extent permitted by law, the website and free scoreboard are provided as available, without a guarantee of uninterrupted, error-free operation or fitness for a particular purpose. We may maintain, change or discontinue features and may suspend abusive or unlawful use proportionately. This does not excuse fraud, intentional wrongdoing, nonwaivable privacy obligations or other liability that cannot lawfully be excluded, or reduce specific obligations in a signed agreement. These terms impose no mandatory arbitration, class-action waiver, general release or fixed damages cap.

10. Disputes, changes and contact

California law governs these website terms, excluding conflict-of-law rules, with competent courts in Orange County, California where lawful. Mandatory local, consumer and employment rights, agency complaints and applicable small-claims remedies remain available. Contacting us does not waive legal deadlines.

We will identify revisions and provide suitable notice of material changes, obtaining new agreement where required. Posting revised terms does not retroactively transfer ownership or authorize a new use of previously collected personal data. If a provision is unenforceable, the remainder applies only to the extent lawful.
